1. Prohibited Materials and Activities
1.1. The Subscriber must use the Services in accordance with the applicable legislation of Ukraine and other mandatory legal provisions applicable to their activities. The Subscriber is solely responsible for the legality of hosted materials, installed software, and activities carried out using their servers.
1.2. The Services must not be used for the unlawful hosting, storage, copying, publication, or distribution of materials that infringe copyrights, related rights, or other intellectual property rights of third parties, including the distribution of counterfeit software and other materials without the appropriate rights.
1.3. The Services must not be used for:
1.3.1. Creating and distributing phishing pages, stealing account credentials or payment information, fraud, pyramid schemes, fraudulent payment pages, or other illegal schemes.
1.3.2. Unauthorized access to third-party information systems, scanning or exploiting their vulnerabilities without the owner's permission, organizing or participating in DDoS attacks, spoofing source IP addresses (IP spoofing), or other activities intended to disrupt networks, servers, or services.
1.3.3. The unlawful sale, advertising, or distribution of narcotic drugs, psychotropic substances, or other goods or services whose circulation is prohibited or restricted by law.
1.3.4. Conducting activities for which the law requires a license or other authorization without obtaining the relevant document.
1.3.5. Hosting or distributing materials whose dissemination is prohibited by Ukrainian legislation, including materials containing unlawful incitement to violence or hatred.
1.3.6. Creating, hosting, distributing, or operating botnets, command-and-control servers (Command and Control, C&C), ransomware, Trojans, data-stealing software, or other malicious software.
1.4. Hosting information security-related materials, using cryptocurrencies, conducting lawful prize draws, or being involved in a dispute concerning a website does not, in itself, constitute a violation of these Terms. Restrictions may be imposed on the basis of specific prohibited activities or other circumstances provided for by Ukrainian legislation and the Agreement.
1.5. Upon receiving a substantiated report of a possible violation, the Provider has the right to request that the Subscriber remedy the violation or provide explanations and evidence of the legality of their actions within 48 hours of the notice being sent. If the violation poses an immediate threat to security, infrastructure stability, or the Services of other subscribers, the Provider has the right to immediately restrict or suspend the relevant Services without prior notice. Other measures are applied in accordance with the Public Offer and applicable Ukrainian legislation.
-
2. Prohibition of Spam
2.1. For VPS, outbound connections through ports 25, 465, and 587 are blocked by default. These ports may be unblocked following successful identification of the Subscriber and approval of the corresponding request by the Provider. Unblocking these ports does not grant permission to send spam.
2.2. The Services must not be used to send unsolicited bulk messages (spam), including by email, messaging applications, or other electronic communication methods, or to organize, facilitate, or conceal such mailings.
2.3. If the Subscriber's Services are used to send spam or conduct other activities resulting in substantiated complaints or restrictions on the availability of network resources, the Provider has the right to require the violation to cease, restrict the relevant network connections, or suspend the Services. The mere inclusion of an IP address on a blocklist does not constitute conclusive evidence of a violation and must be assessed in light of the available circumstances.
-
3. Server Security and Malicious Software
3.1. The Subscriber is responsible for configuring and securing the operating system, application software, accounts, and data on the rented server within the scope of the access granted to them. The Subscriber is advised to install security updates promptly, use strong passwords, enable multi-factor authentication where available, and restrict access to administrative interfaces.
3.2. The Services must not be knowingly used to create, host, distribute, or operate malicious software, botnets, or other tools intended for unauthorized interference with third-party systems. Information security research conducted lawfully and without infringing the rights of third parties does not, in itself, constitute grounds for blocking.
3.3. If signs of server compromise, malware distribution, or dangerous network activity are detected, the Provider may notify the Subscriber and require the issue to be resolved. If the activity poses an immediate threat to the infrastructure or third parties, the Provider has the right to immediately and temporarily restrict network access or suspend the relevant Service until the threat has been eliminated.
3.4. The Subscriber must promptly notify the Provider of any known instances of unauthorized access that may threaten the Provider's infrastructure or the Services of other subscribers. Notifications may be sent to [email protected] or through the support system in the Service Control Panel.
-
4. Resource Usage and Service Restrictions
4.1. The Subscriber has the right to use computing resources, RAM, disk space, and other server specifications within the limits of the ordered service plan. Prolonged use of available CPU resources at maximum capacity does not, in itself, constitute a violation of these Terms.
4.2. If the Subscriber's resource usage negatively affects the stability of equipment, the network, or the Services of other subscribers, the Provider has the right to notify the Subscriber of the need to eliminate the causes of such impact and propose a technical solution or a change of service plan. If the threat is not eliminated, the Provider may temporarily restrict the relevant resources or suspend the Services in accordance with the Public Offer. Immediate measures may be taken in the event of an imminent threat.
4.3. The Subscriber must use operating systems and other software in compliance with the applicable licensing terms. Unless it is expressly stated during the ordering process that a license for specific software is included in the Service, the Bring Your Own License (BYOL) principle applies: the Subscriber is solely responsible for obtaining valid licenses and the necessary rights to use the relevant software, including Microsoft Windows and other commercial software. Providing an operating system image or installation files does not, in itself, constitute the provision of a license or the right to use the software without proper activation.
4.4. The Services must not be used to operate or provide third parties with public network services that pose an increased risk of abuse, including:
4.4.1. Open proxy servers and open DNS resolvers accessible to an unrestricted number of users.
4.4.2. Public or commercial VPN services and anonymization or traffic transit services for third parties.
4.4.3. Services intended to conceal the source of illegal activities, circumvent technical restrictions in violation of the law, or facilitate network attacks.
4.5. The restrictions set out in clause 4.4 do not apply to the Subscriber's use of a private VPN for their own secure access to the server or to other lawful non-public network services that do not violate these Terms.
4.6. The Services must not be used for cryptocurrency mining, including mining cryptocurrencies using central processing units (CPU), graphics processing units (GPU), participating in mining pools, or running mining software, regardless of the level of resource usage. Unauthorized cryptocurrency mining (cryptojacking) using third-party resources without permission is also prohibited. The use of cryptocurrency wallets and other lawful blockchain services without mining is not, in itself, prohibited.
4.7. Operating open mail relays (open SMTP relay), spoofing source IP addresses, and intentionally generating network traffic that disrupts the Provider's infrastructure or third-party networks are prohibited.

5. Handling Copyright Infringement Complaints
5.1. The Subscriber is solely responsible for complying with copyrights, related rights, and other intellectual property rights when using the Services. The Provider supplies technical infrastructure and does not conduct prior reviews of all materials hosted by the Subscriber on their server.
5.2. Upon receiving a complaint from a rights holder or their authorized representative concerning a possible infringement, the Provider reviews it in accordance with Ukrainian legislation, including the Law of Ukraine "On Copyright and Related Rights", and, where necessary, forwards information about the alleged infringement to the Subscriber with a request to provide an explanation or remedy the violation.
5.3. The Subscriber must promptly review duly received notices of possible infringements, provide substantiated responses, and take measures required by Ukrainian legislation. Where a specific complaint is subject to a special procedure established by law, the Parties must comply with the requirements and deadlines prescribed by that procedure.
5.4. The Provider has the right to restrict access to the relevant materials or Services in the cases and according to the procedures established by Ukrainian legislation, these Terms, and the Public Offer. If a valid objection or confirmation that the infringement has been remedied is received, the question of restoring access is resolved in accordance with the applicable procedure and legal requirements.
5.5. Notices concerning possible infringements of intellectual property rights may be sent to [email protected]. The Provider may request documents or information necessary to verify the complainant's authority and the grounds for the complaint.
